Affiliate Program Terms and Conditions

These Affiliate Program Terms and Conditions (hereinafter referred to as the “Agreement”) are entered into between Scottsdale Mint (hereinafter referred to as the “Company,” “we,” “us,” or “our”) and you (hereinafter referred to as the “Affiliate” or “you”). By participating in our affiliate program, you agree to comply with the terms and conditions outlined below. Please read these terms carefully before joining our affiliate program.

1. Changes to Referral Rates

We reserve the right to change the referral rates at any time without prior notice. Changes to referral rates will be effective immediately upon publication on our affiliate portal or by notifying you via email. It is your responsibility to regularly review the referral rates.

2. Termination of Affiliate Membership

We may, at our sole discretion, terminate your affiliate membership at any time and for any reason, including but not limited to violation of these terms and conditions, fraudulent activity, or any other behavior that we deem detrimental to the Company. Upon termination, you will immediately cease to earn commissions, and any accrued but unpaid commissions may be forfeited.

3. Professional Conduct

By becoming an affiliate, you promise to conduct yourself in a professional manner and agree not to engage in any illegal, unethical, or behavior that may harm the reputation of the Company. This includes but is not limited to spamming, false advertising, misrepresentation of our products or services, or any other actions that could reflect poorly on the Company.

4. Payment Terms

a. Commissions earned through the affiliate program will be paid out in accordance with the payment schedule outlined on our affiliate portal.

b. We reserve the right to determine the method of payment for commissions, which may include cash, digital payments, or store credit. This decision will be at our sole discretion.

c. Commissions may be subject to a minimum payout threshold as specified on our affiliate portal.

d. Payments will be made in the currency specified on our affiliate portal, and you are responsible for any currency conversion fees.

e. You are responsible for providing accurate and up-to-date payment information to receive commissions. We are not responsible for any delays or non-payment due to incorrect payment information provided by you.

f. All taxes associated with your commissions are your responsibility, and you agree to comply with all applicable tax laws and regulations in your jurisdiction.

5. Affiliate Links and Tracking

a. You will receive unique affiliate tracking links to promote our products or services. It is your responsibility to ensure that these links are used properly and are not modified in any way.

b. We are not responsible for tracking errors that may occur due to technical issues or user error.

c. Commissions will only be paid for sales or actions that are properly tracked through your affiliate links.

6. Confidentiality

You agree to keep any confidential information obtained through the affiliate program confidential and not to disclose it to any third parties.

7. Modification of Terms

We reserve the right to modify these terms and conditions at any time, and such changes will be effective immediately upon publication on our affiliate portal or by notifying you via email. It is your responsibility to regularly review these terms.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Arizona.

By participating in our affiliate program, you acknowledge that you have read, understood, and agreed to these terms and conditions. If you do not agree to these terms, please do not join our affiliate program.

9. No Business Relationship

This Agreement does not create any joint venture, partnership, agency, employment, or franchise relationship between you and the Company beyond the scope of the affiliate program. You are an independent contractor, and nothing in this Agreement shall be construed to make you an employee, agent, or legal representative of the Company. You shall have no authority to bind the Company to any obligations, and you shall not hold yourself out as an employee or agent of the Company. You are solely responsible for all taxes, insurance, and other obligations that may be applicable to your status as an independent contractor.

10. How the Affiliate Program Works

a. After joining our affiliate program, you will receive unique affiliate tracking links that you can use to promote our products or services.

b. When a customer clicks on your affiliate link and makes a qualifying purchase, you earn a commission based on the referral rates specified in the affiliate program.

c. Payments for commissions are typically held for a period of 60 days from the date of the referred sale. This holding period is to ensure that no returns, cancellations, or chargebacks occur, as commissions may be adjusted accordingly.

d. After the 60-day holding period, your earned commissions will be eligible for payout, subject to meeting the minimum payout threshold as specified on our affiliate portal.

e. It is your responsibility to regularly check your affiliate dashboard for commission updates and payment statuses.

f. We may provide you with marketing materials, banners, and other resources to help you promote our products or services effectively.

11. Program Changes and Early Testing Phase

a. Please be aware that our affiliate program is in an early testing phase, and as such, it may undergo changes or updates at any time. We reserve the right to modify or terminate the affiliate program, its terms, and referral rates without prior notice.

b. While we aim to provide you with a stable and reliable affiliate program, we cannot guarantee its permanence in its current form, and you acknowledge this as part of your participation.

12. Fraud and Termination

a. Any attempts to manipulate, abuse, or defraud the affiliate program, including but not limited to click fraud, self-referrals, or artificially inflating referral numbers, will result in immediate termination of your affiliate membership.

b. In cases of fraud or abuse, we reserve the right to take legal action to recover damages and protect our interests.

13. New Customer Referrals and Commission Duration

a. Commissions earned through the affiliate program are applicable only to new customers who have not previously made a purchase or engaged with our products or services.

b. You may earn commissions on new customer referrals for up to one year from the date of the customer’s initial purchase through your affiliate link.

c. After the one-year period, you will not be eligible to earn commissions on subsequent purchases made by the referred customer.
